Terms & Conditions of Sale

The following Terms and Conditions of Sale apply to all products purchased on atmosled.co and its authorized third-party online marketplace outlets.

For invoice purchases through our sales department, please refer to the sales agreement on your sales order.

 

Online Order Acceptance

All online purchases for LED video panels or video wall package SKUs without prior contact with Atmos LED are subject to technical review and acceptance after checkout. Should an order not meet minimum technical requirements or not contain required accessories, the order may be canceled with payment refunded to the customer.

 

Acceptance of Terms

Atmos LED’s commencement of performance and/or delivery shall not constitute a waiver of these terms and conditions or acceptance of any terms contained in the customer’s purchase order or other documents. Acceptance of any product, service, or remission of payment by the customer constitutes acceptance of Atmos LED’s terms and conditions. Any dispute with respect to any order placed with Atmos LED shall be governed by the laws of the applicable state or jurisdiction.

 

Payment Policy

All online purchases require payment in advance via credit card, electronic funds transfer (ACH/Wire), or other approved payment methods. Alternatively, we will offer financing on the site. Orders will not begin processing until payment has been cleared and/or financing has been completed.

Payment stops, reversals, or chargebacks may result in order cancellation or withholding of further performance. In the event of a payment reversal after equipment has been delivered, Atmos LED may pursue collection efforts, including but not limited to equipment repossession. Any incurred costs may be recovered.

 

Delivery & Transfer of Goods

Atmos LED will make reasonable efforts to ship orders for delivery on or before estimated timelines listed at checkout or in order communications. Delivery estimates are not guaranteed and do not constitute a contractual obligation.

Atmos LED reserves discretion over shipping method and carrier. Shipments are FOB Atmos LED’s shipping point. Risk of loss transfers to the customer upon shipment. Partial shipments may occur without customer permission.

If delivery is delayed due to customer inability or refusal to accept delivery, Atmos LED may, at its discretion, store the order at the customer’s expense. Any associated costs (including storage, insurance, and handling) shall be immediately payable by the customer.


International Shipping Policy

Customers are solely responsible for determining export licensing requirements, obtaining necessary licenses or authorizations, and handling customs formalities. Commercial invoices will be provided upon shipment. The customer is responsible for all duties, taxes, VAT, and customs fees. Delivery is considered complete upon export from the origin country.

 

Inspection Period & Damage Policy

There is a strict fifteen (15) day inspection period from receipt to report shortages or damaged goods. All claims must be made directly with the carrier. Atmos LED will provide reasonable assistance in the claims process but does not waive payment obligations or invoice terms.

 

Order Change Policy

Changes to processing orders more than seven (7) business days after submission may be subject to a change fee of 3% of the total purchase price. Accessories or materials already produced or ordered specifically for the purchase cannot be removed after production or ordering, whichever occurs first.

 

Cancellation Policy

Orders may be canceled without penalty within three (3) business days of submission. After this grace period, cancellations prior to shipment will incur a 10% cancellation fee.

Custom orders, non-stock products, or orders that have exceeded thirty (30) calendar days after submission but have not shipped are non-cancelable.

 

Return Policy

Return eligibility is determined by the purchase category below. Product malfunctions and/or material defects are covered under the Atmos LED Limited Warranty.

  • Video Wall Packages (Mobile / Rental): All sales are final unless a manufacturing defect is present. Please reference the Atmos LED Limited Warranty for further details regarding defects.

  • Video Wall Packages (Fixed Install): Not eligible for return.

  • Digital Signage: Not eligible for return.


Force Majeure

Atmos LED shall not be liable for delays or failures due to circumstances beyond reasonable control, including but not limited to acts of God, labor disputes, supply shortages, governmental actions, transportation interruptions, pandemics, or natural disasters. Such events do not constitute grounds for cancellation.

 

Future Expansion / Additions

Customers acknowledge that color, brightness, and performance variations may occur due to LED manufacturing characteristics. Atmos LED does not guarantee exact color or brightness matching for future expansions or additions. Variations caused by different production batches are not returnable or covered under warranty.

 

Installation & Deployment Responsibility

Unless explicitly stated, on-site installation services are not included. Customers are responsible for proper installation and ensuring compatibility with their intended environment. Any third-party installation services are excluded from Atmos LED’s warranty. Atmos LED reserves the right to assign an authorized service provider for warranty claims.
